The steps to being assigned a public defender

  1. Find your local SPD office and reach out. The staff can help fill out your application, answer your questions, and guide you through the process.
  2. Submit your application for public defender services.
  3. SPD will review your application.
  4. If approved, you will be appointed a public defender to represent you.
  5. If your application is denied, you may be able to receive an attorney from the county.

Fees and payments

It’s a common misconception that public defenders represent clients for free. Fees are mandated by Wisconsin State Statute 977.075. The fee amount you are charged depends on the type of case you have. Multiple cases will result in multiple fees. The money paid is used to cover administrative costs and is not used to pay your attorney.
