 A juvenile adjudged delinquent for certain sex offenses must register as a sex offender unless the court permanently stays the requirement under the standards established in §§ 301.45(1m)(e) and 938.34(15m) and State v. Cesar G., 2004 WI 61, 272 Wis. 2d 22, 682 N.W.2d 1. The circuit court in this case properly applied those standards when it declined to stay the registration requirement for G.R.H.

COA: No First Amendment interest in legally changing name for transgender person

State v. C.G., 2021 WI App 11; petition for review granted 4/27; case activity

Ella–a pseudonym–was adjudicated delinquent for a sexual assault committed when she was 15. Ella’s legal name is masculine in association; during her juvenile disposition she was transitioning to a female identity. In this appeal she challenges the circuit court’s refusal to stay sex offender registration under Cesar G., and also submits that the registry’s prohibition on changing her legal name violates her First Amendment right to express her identity. The court of appeals upholds the circuit court’s discretionary decision on the former claim; on the latter it offers three blithe paragraphs of discussion before casually announcing–in a decision that is set to be published, and thus binding–that requiring a transgender woman to use a man’s name implicates no First Amendment concerns whatsoever.

COA upholds decision to make juvenile register as sex offender

State v. D.I.G., 2019AP855, 2/5/2020, District 2 (one-judge decision; ineligible for publication); case activity

The juvenile here was found delinquent for sexual contact with his younger sister. He moved the court for a stay of registration under State v. Cesar G., 2004 WI 61, 272 Wis. 2d 22, 682 N.W.2d 1. The court declined to stay registration, disagreeing with the expert assessment the juvenile presented. As you might expect, the court of appeals affirms this discretionary decision.

Bomb scare adjudication upheld, but restitution order reversed in part

State v. J.P., 2017AP1905, District 1, 9/5/18 (one-judge decision; ineligible for publication); case activity

J.P. was adjudicated delinquent for calling in two bomb scares to his high school. The court of appeals rejects his claims that the police lacked probable cause to arrest him and unlawfully searched his phone and that his confession was involuntary. However, the court agrees with J.P. that part of the restitution order is invalid.

Juvenile court’s reliance on wrong sex offender registration statute was harmless

State v. D.J.A.R., 2017AP52, District 4, 8/3/17 (one-judge decision; ineligible for publication); case activity

After D.J.A.R. was adjudicated delinquent for second degree child sexual assault under § 948.02(2), the circuit court ordered him to register as a sex offender. (¶¶4-6). It relied on § 938.34(15m)(am)1., which requires finding that the juvenile’s conduct was sexually motivated and that registration is in the interest of public protection. That was a mistake, because D.J.A.R.’s offense is governed by § 938.34(15m)(bm), which mandates registration unless the requirements of § 301.45(1m) are met. (¶¶11-14). The mistake was harmless, however. (¶15).

Court of appeals upholds $1,600 restitution award imposed on 14-year-old

State v. J.J.S., 2016AP1519, 4/25/17, District 3 (1-judge appeal; ineligible for publication); case activity

The case appears to be an issue of first impression: Whether §938.34(5)(c), which provides that juveniles under 14 can’t be required to pay more than $250 in restitution, refers to the juvenile’s age when the State filed the delinquency petition or the juvenile’s age at the time of disposition. The court of appeals, choosing the time of disposition, upholds the $1,600 restitution award against J.J.S., even though he was just 13 when the filed its petition.

No error in denying juvenile stay of sex offender registration

State v. F.B., 2016AP497, 11/1/16, District 1 (one-judge decision; ineligible for publication); case activity

F.B. seeks reversal of the circuit court’s denial of a permanent stay of his obligation to register. No briefs are available and it is difficult to tell what his argument might have been; in any case the court of appeals holds the circuit court properly exercised its discretion.

Defense win! Court of appeals vacates order lifting stay on sex offender registration

State v. D.C.M., 2016AP1205-FT, 10/5/16, District 2 (1-judge opinion; ineligible for publication); case activity

The stay of a dispositional order in a juvenile case cannot be lifted unless the parties and the court follow the notice and hearing requirements of §938.34(16).  They failed to do so in this case, so the court of appeals reversed the circuit court’s order lifting the stay on D.C.M.’s sex offender registration.
